Waste plan appeal rejected

East Sussex County and Brighton and Hove City Councils have welcomed a decision by the Court of Appeal to refuse a further challenge to the Waste Local Plan.

The Waste Local Plan sets out planning guidance on how waste should be dealt with in the future and where key waste facilities, such as the Newhaven incinerator, should be built.

The challenge was mounted by Newhaven resident, Nicola Day, in a bid to have parts of the plan declared null and void. Her challenge was defeated in the High Court and now the Court of Appeal has supported the High Court Decision.

Welcoming the judgement, county council leader Peter Jones, said: 'This challenge has cost tax payers about 150,000, including most of Ms Day's costs - money that surely would have been better spent on much needed services rather than legal fees. But I am very pleased we now have a document that gives clear guidance for decisions on waste planning applications across East Sussex and Brighton and Hove. This judgement reflects the excellent work that went into developing this plan.'
