Pompey begin points loss fight

Pompey are gearing up their challenge to overturn their 10-point deduction this season.

Administrator Trevor Birch admits the Blues face a battle to fight the loss – but that they are prepared to tackle the Football League over it.

Pompey have launched an appeal for creditors of the club’s old company to get in touch with them.

That’s in response to the league sanctions – specifically the additional points loss.

The deduction relates to creditors from the 2010 Company Voluntary Arrangement (CVA), which was not settled when Pompey went into administration for a second time in February.

With there being no direct appeal process, Pompey believe they could question the ruling if 75 per cent of those creditors indicate they are in favour of the new CVA approved in June.

Liquidators of Pompey’s old company, Baker Tilly, voted in favour of the latest CVA on behalf of those creditors – but the league didn’t see that as grounds not to deliver the deduction.

Birch is now planning to lobby the League to overturn the decision. He said: ‘There is no sort of appeals process to undertake (with the Football League).

‘It’s just trying to find a way of possibly getting to the creditors of the oldco CVA.

‘But that would have to be done through the liquidator of the oldco and would not be a straightforward process.

‘They (Baker Tilly) should be able to vote on behalf of the creditors because they are a liquidator. They have the power of attorney to act on behalf of the creditors.

‘But that wasn’t sufficient for the Football League.’
